Please understand that whilst we will continue to make every reasonable effort to ensure that our key public meetings at which important decisions are live streamed and recorded, any failure in that technology does not in any way invalidate the legitimacy of that meeting or of the decisions taken at it. Even in the event of such occasional technical failures, the public gallery will still have been open, as required by law, and the minutes of the meetings will still be made available in due course.

The Licensing Officer presented the report which asked members to determine the license application for The Starr Inn at Market Place, Great Dunmow, Essex, CM6 1AX.

 

In response to questions from members, the Licensing Officer said: -

·               The premises had been licensed on and off over previous years but had been an established pub since the 15th century.

·               There were no complaints relating to car parking, but this did not form part of the licensing process

 

 

The relevant authorities stated they had worked with the Designated Premises Supervisor (DPS) of the premises, who they had mistaken for the applicant at the time.

 

In response to a question from a member, the Police Licensing Officer said there had been no reports of crime and disorder associated with the premises.

 

A resident and representative of other residents of Starr Lane, addressed the Panel in objection to the application on the grounds that the proposed hours were unsuitable and would cause a public nuisance. The resident had introduced themselves as Daniel Gowing at the meeting, but their representation as published in the report had been made under the name of Daniel Coleman. The following points were raised: -

  • He had experienced issues in the past e.g. broken bottles outside his property, people vomiting and urinating against his property. He added that staff from the Starr had been helpful and accommodating regarding these issues e.g. cleaning up broken glass
  • The temporary events system was more appropriate and necessary than the terms of the application in question
  • The properties in the vicinity of the premises were listed and were therefore unable to be soundproofed
  • He and residents would prefer the premises to have the same hours as the existing license. They felt opening anytime past 1.00 was unreasonable
  • He did not believe playing quieter music between 1.00 and 2.00 would adequately alleviate noise as it would still be caused by intoxicated people congregating outside
  • Residents feared later hours would attract intoxicated people late at night from establishments that closed earlier and there were no door staff at the Starr Inn to manage this
  • The applicant had displayed notice of the application but had not taken steps to approach residents directly to consider their views
  • People could congregate outside the premises following closing time in order to wait for taxis, which were known to take up to an hour in the area
  • Residents were not against the applicant or their business and spoke favourably of the staff, but were opposed to the hours in the application
  • He had been sworn at by people waiting in their car outside his house

 

In response to questions from members, he said: -

  • Incidents relating to the premises were happening as frequently as every weekend
  • He was certain broken glass found on his doorstop came from the Starr
  • He had not reported any of the mentioned incidents to the police, but had reported them to Dunmow Town Council
